Terms of Service
These Terms of Service ("Terms") govern access to and use of
the public website at bosoptimization.com and the
client portals operated by BosOptimizations, Inc. ("BosOptimizations",
"we", "us"), under the product brand BosOpt Automations. By using
our website or our software, you agree to these Terms.
Services
BosOptimizations provides custom business-operations software, integrations, and consulting services to client organizations under the BosOpt Automations brand. The specific features, scope, and service-level commitments available to any individual user are governed by the contract between BosOptimizations and that user's client organization, not by this public document.
Acceptable use
You agree not to use BosOptimizations-operated systems to:
- Violate any applicable law or regulation.
- Infringe the intellectual property or privacy rights of others.
- Send spam, unsolicited messages, or content that violates Twilio's, Google's, or any other underlying provider's acceptable-use policy.
- Attempt to gain unauthorized access to any portion of the service, another tenant's data, or the underlying infrastructure.
- Reverse-engineer, decompile, or otherwise attempt to derive the source code of our software, except as expressly permitted by law.
Authorization & access
Access to a BosOptimizations-operated portal requires authorization from the relevant client organization. We may rely on the email domain associated with your Google Workspace account, on explicit allowlists provided by your organization, or on other reasonable signals of authorization. We may suspend or revoke access without notice if we determine that access is unauthorized or that continued access would create risk for other tenants, your organization, or BosOptimizations.
Third-party platforms
BosOptimizations-built systems integrate with third-party platforms including Google Workspace, Intuit QuickBooks Online, Twilio, and others as configured per client. Your use of those platforms through our software remains subject to each platform's own terms. We are not responsible for the availability, behavior, or content of those platforms.
Intellectual property
All software, designs, copy, and other materials produced by BosOptimizations remain the property of BosOptimizations or its licensors. Use of BosOptimizations software by a client organization is governed by the contract between BosOptimizations and that organization. Nothing on the public website grants any license or right beyond reading the publicly available content.
No warranty
Information on the public website is provided "as is" without warranties of any kind. The terms applicable to BosOptimizations-operated software in production are governed by the master services agreement between BosOptimizations and the client organization.
Limitation of liability
To the maximum extent permitted by law, BosOptimizations is not liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the public website. Liability for production services is governed by the contract between BosOptimizations and the client organization.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the website or software after a change constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Suffolk County, Massachusetts.
